This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and Cristian Privado (with future operations under Privado Designs) governing your use of the Lumin – Social mobile application (“Lumin” or “App”).

This EULA supplements, and does not replace, the Apple Media Services Terms and Conditions and Apple’s Licensed Application End User License Agreement (LAEULA).

By downloading or using Lumin, you agree to be bound by this EULA.

1. Acknowledgement

This EULA is between you and Lumin, not Apple.

Apple is not responsible for:

• The App or its content

• Maintenance or support

• Claims relating to the App

• Addressing intellectual property disputes

2. Scope of License

Lumin grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by Apple’s App Store rules.

You may not:

• Copy, modify, reverse engineer, or redistribute the App

• Use the App for unlawful purposes

• Circumvent security or access controls

3. Maintenance & Support

Lumin is solely responsible for providing maintenance and support for the App.

Apple has no obligation to provide any support services for Lumin.

4. Warranty Disclaimer

The App is provided “AS IS” and “AS AVAILABLE.”

To the maximum extent permitted by law, Lumin disclaims all warranties, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

Apple provides no warranty with respect to the App.

5. Product Claims

Lumin, not Apple, is responsible for addressing any claims relating to the App, including:

• Product liability claims

• Claims that the App does not conform to legal requirements

• Consumer protection claims

6. Intellectual Property Rights

If a third party claims that the App or your use of it infringes intellectual property rights, Lumin, not Apple, is solely responsible for investigation, defense, settlement, and discharge of the claim.

7. Legal Compliance

You represent that:

• You are not located in a country subject to U.S. government embargo

• You are not listed on any U.S. government prohibited or restricted party list

8. Third-Party Services

The App may use third-party services or infrastructure. Use of such services is subject to their respective terms.

9. Termination

This license is effective until terminated.

Lumin may terminate this license at any time if you:

• Violate this EULA

• Violate the Terms of Service

• Engage in unlawful or harmful behavior

Upon termination, you must stop using the App and delete it from your devices.

10. Limitation of Liability

To the maximum extent permitted by law:

• Lumin shall not be liable for indirect, incidental, or consequential damages

• Apple shall have no liability whatsoever related to the App

11. Governing Law

This EULA is governed by the laws of the United States, without regard to conflict-of-law principles.

12. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
