Privado Designs Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement govern access to and use of the websites, applications, products, services, content, and related digital experiences offered by Privado Designs, including Lumin and any current or future apps, features, tools, or releases published, operated, developed, announced, tested, distributed, or otherwise made available by Privado Designs. In these Terms, “Privado Designs,” “we,” “us,” and “our” refer to Privado Designs as the parent studio and operator of its services, and “Services” refers collectively to the Privado Designs website, Lumin, and any other current or future applications or offerings under the Privado Designs name.
By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
1. Eligibility and Use of the Services
The Services are intended only for individuals who meet the minimum age requirement stated in the applicable product experience. For Lumin, users must be at least 18 years old. By using Lumin or any other Privado Designs service that contains an age-gated environment, you represent and warrant that you meet the applicable minimum age requirement, that you are legally capable of entering into a binding agreement, and that you will not access or use the Services if you do not satisfy those requirements.
Access to the Services is granted on a limited, revocable, non-exclusive, non-transferable basis, and only for lawful use consistent with these Terms. No ownership interest in the Services is transferred to you.
2. End User License Agreement
Subject to your continued compliance with these Terms and any applicable platform rules, Privado Designs grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use the applicable Services on compatible devices that you own or control, solely for your personal, lawful, and intended use. This license is granted, not sold, and no ownership interest in any software, application, feature, design, code, content, or underlying technology is transferred to you.
You may not copy, modify, distribute, sell, lease, sublicense, decompile, reverse engineer, disassemble, attempt to derive source code from, create derivative works from, or otherwise exploit any portion of the Services except to the extent that applicable law expressly prohibits such restriction. You may not use the Services in a way that violates these Terms, violates applicable law, circumvents technical protections, or interferes with the intended operation, integrity, or security of the Services. Any rights not expressly granted are reserved by Privado Designs and its licensors.
This End User License Agreement is intended to operate together with these Terms of Use. To the extent a platform marketplace imposes additional mandatory end-user rights or restrictions, those rights apply only to the extent required by that marketplace or applicable law and do not otherwise expand any license granted by Privado Designs.
3. Accounts and Registration
Certain Services require you to create an account. When you register, you agree to provide information that is accurate, current, and complete, and you agree not to impersonate any other person or entity or misrepresent your identity or affiliation. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
You must promptly notify us if you believe your account has been compromised or used without authorization. We may suspend, restrict, or terminate access to any account that appears to be insecure, misleading, fraudulent, abusive, or in violation of these Terms.
4. Platform Rules and Prohibited Conduct
You may not use the Services in any way that is unlawful, abusive, deceptive, harmful, or inconsistent with the intended operation of the platform. This includes using the Services to harass, threaten, intimidate, impersonate, defraud, scam, exploit, stalk, or otherwise harm other users or third parties. It also includes posting or transmitting content that is illegal, infringing, malicious, sexually exploitative, violently threatening, hateful, privacy-invasive, or designed to interfere with the operation or security of the Services.
For Lumin and any other user-generated or interactive Services operated by Privado Designs, there is no tolerance for objectionable content or abusive users. Content or conduct that is abusive, exploitative, threatening, hateful, predatory, sexually exploitative, privacy-invasive, fraudulent, or otherwise objectionable may result in immediate moderation or enforcement action, including content removal, account restriction, suspension, or permanent termination.
You may not attempt to gain unauthorized access to accounts, systems, or data, reverse engineer or interfere with the platform, automate abusive behavior, scrape content without permission, evade moderation or safety systems, or create replacement accounts to bypass restrictions or enforcement actions.
5. User Content and Platform License
The Services may allow users to create, submit, upload, send, publish, display, or otherwise make available content, including text, profile information, messages, images, video, comments, reposts, metadata, and other materials. You retain ownership of content you create, subject to the rights you grant to us under these Terms.
By posting or submitting content through the Services, you grant Privado Designs a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, publish, display, distribute, moderate, and otherwise use that content solely as reasonably necessary to operate, provide, secure, improve, promote, and enforce the Services. This license continues for as long as the content is stored or used in connection with operation of the Services, subject to deletion processes, backup retention, legal obligations, and legitimate operational needs.
You represent and warrant that you own the content you submit or that you have all rights, permissions, and authority necessary to make that content available and to grant the rights described in these Terms.
6. Moderation, Restriction, and Enforcement
Privado Designs reserves the right, but not the obligation, to review, remove, limit, disable access to, or take action against any content, account, feature access, or behavior that we determine, in our sole discretion, violates these Terms, violates any related policy, creates legal exposure, creates safety risk, harms the platform, or is otherwise objectionable. Enforcement may include warning, visibility limitation, content removal, feature restriction, temporary suspension, permanent suspension, or account termination.
We may act with or without prior notice depending on the nature and severity of the issue. Nothing in these Terms requires Privado Designs to host, preserve, publish, or restore any content, account, or feature access.
7. Third-Party Services and Infrastructure
The Services may rely on third-party providers, infrastructure, app distribution platforms, payment systems, hosting vendors, analytics services, cloud providers, or authentication tools. Privado Designs is not responsible for outages, interruptions, pricing changes, or failures caused by third-party systems beyond our reasonable control. Use of third-party services may also be subject to the applicable third party’s own terms and policies.
8. Subscription Terms and Billing
Certain Services offered by Privado Designs may include optional paid features, premium access, or subscription-based functionality made available through Apple In-App Purchase or other authorized payment channels. For Lumin, Privado Designs may offer Lumin Analytics as an auto-renewable subscription. The subscription title, billing period, and purchase price are disclosed to the user in the app at the time of purchase.
For Lumin Analytics, the current subscription offering is $14.99 per month as an auto-renewable subscription, unless otherwise updated and displayed in the app or through the applicable storefront. Payment will be charged to the user’s Apple ID account at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current billing period. The user’s Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period at the then-current price, unless otherwise disclosed by Apple or the applicable storefront.
Users may manage or cancel subscriptions through their Apple ID account settings after purchase. Deleting the app does not automatically cancel an active subscription. Refunds, if any, are handled by Apple in accordance with Apple’s applicable billing and refund policies, except where otherwise required by law.
Privado Designs reserves the right to modify, replace, limit, suspend, or discontinue paid features, subscription offerings, pricing, included benefits, or availability at any time to the extent permitted by applicable law and platform rules. Continued use of a paid feature after any validly disclosed change constitutes acceptance of the updated subscription terms.
9. Intellectual Property Rights
All rights, title, and interest in and to the Services, excluding user content, including all software, design, branding, text, graphics, interfaces, logos, audiovisual materials, page layouts, features, and underlying technology, are and remain the property of Privado Designs or its licensors. You may not copy, distribute, modify, reproduce, republish, sell, lease, license, decompile, reverse engineer, frame, mirror, or otherwise exploit any portion of the Services except as expressly permitted in writing.
10. Deactivation, Deletion, and Termination
Where account tools are available, users may deactivate or request deletion of their accounts subject to the product’s stated deletion process. For Lumin, deactivation and deletion may involve waiting periods and cancellation rights if the user logs back in before final removal. Privado Designs may preserve certain records, logs, or information where required by law, necessary for fraud prevention, necessary to resolve disputes, or reasonably required for security and enforcement purposes.
Privado Designs may suspend or terminate your access to the Services at any time if you violate these Terms, violate applicable law, create risk for other users, interfere with the Services, or expose us to legal, reputational, operational, or safety harm.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Privado Designs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, availability, accuracy, security, and reliability. We do not guarantee that the Services will be uninterrupted, error-free, secure, or free from loss, delay, or unauthorized access, or that any content will remain available.
12. Limitation of Liability
To the fullest extent permitted by law, Privado Designs and its owners, operators, affiliates, licensors, contractors, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or other intangible losses arising out of or related to your access to or use of the Services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of Privado Designs for any claim arising out of or related to the Services will not exceed the greater of the amount you paid, if any, for the specific service giving rise to the claim during the twelve months preceding the event giving rise to liability, or one hundred U.S. dollars.
13. Indemnification
You agree to defend, indemnify, and hold harmless Privado Designs and its owners, operators, affiliates, licensors, contractors, service providers, and representatives from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your content, your violation of these Terms, your violation of applicable law, or your violation of any third-party rights.
14. Governing Law
These Terms are governed by the laws of the State of Texas and the applicable laws of the United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Services shall be brought in the appropriate courts located in Texas, unless applicable law requires otherwise.
15. Changes to These Terms
Privado Designs may revise these Terms from time to time. Updated versions become effective when posted on this page unless a different effective date is stated. Your continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms.

Privado Designs does not sell personal information to data brokers in the ordinary course of operating the Services.

For Lumin, deletion may involve a scheduled deletion window before final account removal. Privado Designs uses reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Children and Age-Restricted Use
The Services are not intended for users below the minimum age requirement applicable to the relevant product. For Lumin, users must be at least 18 years old. If we learn that an account has been created or used in violation of an applicable minimum age requirement, we may remove content, suspend access, or delete the account.
9. International Access
The Services may be accessed from locations outside the United States. By using the Services, you understand that information may be processed and stored in countries where we or our service providers operate, subject to applicable law.
10. Your Choices and Requests
You may be able to review or update portions of your account information through the relevant product settings. You may also contact us to request support regarding account access, deletion, or privacy-related concerns. We may require reasonable verification before acting on certain requests. Lumin Community Guidelines

These Community Guidelines apply to Lumin, which is operated by Privado Designs. They exist to define the standards for conduct, expression, safety, and participation within the Lumin platform. Lumin is built for communication, creativity, posting, discussion, and connection, but it is not a lawless environment and it is not a platform for abuse disguised as self-expression.
By using Lumin, you agree to engage with other users in a way that respects safety, legality, and platform integrity.
1. What Lumin Is For
Lumin is intended for people to share thoughts, photos, short-form media, conversations, and public or private interactions within the structure of the app. Disagreement, debate, criticism, humor, personality, and creative expression are all allowed. Abuse, intimidation, deception, exploitation, and conduct that harms the community or platform are not.
2. Respect for Other Users
You may not use Lumin to harass, threaten, stalk, humiliate, impersonate, intimidate, target, or exploit another person. Repeated unwanted interaction, aggressive targeting, severe hostility, degrading treatment, dogpiling, and behavior intended to make another user feel unsafe or unable to participate may result in enforcement action even if a single post appears mild in isolation. Context matters, and patterns matter more than excuses.
3. Hate, Abuse, and Exploitative Conduct
Content or behavior that attacks, degrades, or encourages harm against people on the basis of protected or vulnerable characteristics is not allowed. Severe insults, slurs, dehumanizing language, targeted harassment, and abuse designed to isolate or endanger others are not permitted. Sexual exploitation, coercive conduct, grooming behavior, and exploitative interactions are prohibited.
4. Violence, Criminal Conduct, and Serious Harm
You may not use Lumin to threaten violence, celebrate credible harm, coordinate criminal acts, promote terrorism or extremist violence, or instruct others in conduct that creates real-world danger. Content that presents a credible threat to safety may be removed immediately and may lead to account suspension or permanent removal.
5. Privacy and Personal Information
You may not post private, confidential, identifying, or sensitive information about other people without authorization, including information intended to expose, track, embarrass, or endanger them. Doxxing, non-consensual sharing of private materials, and attempts to weaponize personal information are prohibited.
6. Authenticity and Platform Integrity
You may not impersonate other people, brands, or organizations, mislead others about your identity, run deceptive or fraudulent schemes, manipulate engagement, coordinate fake activity, or use spam tactics that degrade the platform experience. Lumin is not a place for scam behavior, fake authority, or manufactured interaction loops.
7. Content Standards
Lumin may restrict or remove content that is illegal, exploitative, sexually explicit in prohibited ways, dangerously deceptive, malicious, privacy-invasive, hateful, violently threatening, or otherwise inconsistent with the platform’s rules. Even if you think a post is “just a joke,” that does not override platform safety standards, legal obligations, or enforcement discretion.
8. Messaging and Direct Interaction
Signals and any other direct communication features inside Lumin must not be used for harassment, threats, scams, coercion, exploitation, or abusive conduct. Private messages are not exempt from platform rules merely because they are not publicly visible.
9. Reporting and Blocking
Users may report content or accounts that appear to violate platform rules and may block other users to reduce unwanted interaction. Abuse of the reporting system, including bad-faith or retaliatory reporting, may itself be treated as a violation. Blocking is a user control tool and reporting is a moderation tool; they are not the same thing and they do not guarantee the same outcome.
10. Enforcement
Violations of these Guidelines may result in removal of content, limitation of visibility, temporary feature restrictions, account suspension, or permanent account termination. Enforcement decisions are based on severity, context, pattern of conduct, user safety, legal risk, and platform integrity. Lumin is not obligated to provide warnings before acting.

Lumin Content Moderation and Enforcement Policy

This Policy explains how Privado Designs may review, assess, moderate, restrict, or enforce rules within Lumin. It should be read together with the Terms of Use, Privacy Policy, Community Guidelines, Safety Policy, and any other policy appearing on this page.
Moderation exists to preserve platform safety, platform integrity, legal compliance, and the basic ability of users to participate without being overrun by abuse, fraud, or platform manipulation.
1. Scope of Moderation
Moderation may apply to posts, profiles, images, videos, comments, messages, usernames, bios, links, reports, account activity, metadata, and other conduct occurring within or through Lumin. Moderation may also apply to attempts to misuse platform systems, including repeated evasion, spam patterns, coordinated abuse, or attempts to game visibility or enforcement.
2. Review Triggers
Content or conduct may be reviewed when it is reported by users, flagged by platform systems, surfaced during support review, associated with suspicious activity, or reasonably believed to create safety, legal, operational, or reputational risk. Lumin does not promise continuous manual review of all content, and the fact that something remains visible does not mean it has been approved.
3. Enforcement Criteria
Enforcement decisions may consider severity, credibility, intent, frequency, pattern of behavior, prior history, impact on users, platform manipulation, risk of harm, and legal exposure. A single severe incident may justify immediate permanent action. Repeated lower-level violations may also justify stronger action over time.
4. Enforcement Actions
Privado Designs may issue warnings, remove content, limit content visibility, disable features, restrict messaging, suspend account functions, temporarily suspend accounts, permanently terminate accounts, or take any combination of those actions. We may also preserve relevant data where necessary for investigation, safety, legal compliance, or dispute handling.
5. No Guaranteed Notice or Appeal
We may provide notice where appropriate, but we are not obligated to provide advance notice, live review, or a formal appeal process in every case. In some cases, particularly where safety, fraud, or legal risk is involved, immediate action may be taken without warning.
6. Messages and Private Features
Private or limited-visibility features are still subject to platform rules. If messages or related conduct are reported or reasonably associated with safety or legal concerns, they may be reviewed to the extent reasonably necessary for enforcement, investigation, support, or compliance.
7. Repeat Violations and Evasion
Users who repeatedly violate rules, attempt to return after suspension, create replacement accounts, coordinate abuse, or use alternative profiles or methods to evade enforcement may be permanently removed from Lumin. The platform is not required to offer repeated second chances to users who demonstrate that they cannot or will not follow the rules.
8. Abuse of Moderation Systems
False reporting, report-spamming, harassment through moderation tools, or attempts to weaponize platform enforcement against other users may result in restrictions or account action. The reporting system exists to improve safety, not to settle personal grudges.
9. Legal Cooperation
Privado Designs may preserve, review, or disclose content and account information where required by law, legal process, platform obligations, or credible safety concerns. This may include situations involving threats, exploitation, fraud, or criminal conduct.

Lumin Account Deactivation, Deletion, and Enforcement Status Policy

This Policy explains how account deactivation and deletion work for Lumin and how enforcement-related account restrictions may affect access. It is intended to provide clarity, but it does not override the Terms of Use or limit Privado Designs’ right to take action where safety, abuse, fraud, or legal concerns are involved.
1. Account Deactivation
Lumin may offer users the ability to deactivate an account. Deactivation is intended as a temporary account state that reduces visibility and access without immediately finalizing deletion. During a deactivated period, some content, settings, and account records may remain stored so the account can be restored if the user returns before permanent deletion is completed.
2. Account Deletion
Lumin may offer users the ability to request account deletion. Deletion requests may be processed through a delayed deletion period rather than instant irreversible removal. This exists for operational, fraud-prevention, recovery, and safety reasons. If a user logs back in or otherwise cancels deletion during the applicable waiting period, deletion may be reversed and the account may remain active.
Once a deletion request is fully completed, the account and associated data may be permanently removed or anonymized, subject to technical limits, backup cycles, legal obligations, fraud-prevention records, dispute records, and other legitimate retention needs.
3. What May Be Retained
Even after deletion, Privado Designs may retain limited records, logs, moderation history, support history, technical logs, transactional records, legal records, or security-related information where reasonably necessary to comply with law, resolve disputes, prevent abuse, investigate harm, preserve evidence, or protect the Services and their users.
4. Enforcement-Related Restrictions
If an account is suspended, restricted, or terminated for policy violations, the user may lose access to the account before any voluntary deletion process completes. Privado Designs is not required to restore access to facilitate self-service account actions where enforcement, safety, or legal reasons justify continued restriction.
5. Appeals and Review
Privado Designs may, but is not obligated to, review requests relating to account action. The existence of a contact email does not guarantee reinstatement, reversal, or a formal appeal path. Some decisions may remain final, particularly in cases involving safety threats, exploitation, repeat abuse, fraud, illegal conduct, or severe platform manipulation.
6. Re-Registration and Evasion
Users may not create new accounts to evade suspensions, bans, feature restrictions, or enforcement decisions. Attempting to re-enter the platform under replacement identities after enforcement action may result in broader removal measures across related accounts or identifiers.
7. Data Requests Before Deletion
If a user wants to request support relating to their account before a deletion window expires, they should contact lumin.app@outlook.com as early as possible. Privado Designs is not obligated to provide custom exports, restorations, or recovery after deletion has been finalized.

1. Ownership of Platform Materials
All rights, title, and interest in the Services, excluding user content, including software, code, interfaces, designs, branding, page layouts, logos, graphics, original text, and product presentation, are owned by Privado Designs or its licensors and are protected by applicable intellectual property laws. 3. Copyright Complaints
If you believe that content made available through the Services infringes your copyright, you may send a notice to lumin.app@outlook.com for Lumin-related matters or privadodesigns@outlook.com for website or studio-related matters. A proper notice should identify the copyrighted work claimed to have been infringed, identify the allegedly infringing material with enough specificity to locate it, provide your contact information, include a statement of good-faith belief that the use is not authorized, include a statement made under penalty of perjury that the information is accurate and that you are authorized to act, and include your physical or electronic signature.
Incomplete, vague, abusive, or unsupported notices may not be processed.
4. Response to Notices
Upon receipt of a facially valid copyright complaint, Privado Designs may remove or disable access to the material, notify the relevant user where appropriate, request additional information, preserve records, or take additional steps as required by law or platform policy.
5. Counter-Notices
If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice containing the information reasonably required by applicable law. Submission of a counter-notice does not guarantee restoration of content and may be subject to legal or platform review.
6. Repeat Infringers
Users who repeatedly infringe the intellectual property rights of others may be subject to content removal, account restriction, suspension, or permanent account termination. Privado Designs reserves the right to determine what constitutes repeated infringement based on the totality of circumstances.
7. Trademark and Brand Misuse
You may not use the Privado Designs name, Lumin name, logos, branding, app identity, or trade dress in a way that suggests affiliation, endorsement, sponsorship, or official status without written permission. You may not create confusingly similar identities, pages, marks, or accounts intended to mislead users.
8. False Claims and Abuse
Submitting knowingly false, bad-faith, or abusive intellectual property complaints may result in rejection of the notice, restrictions on use of reporting tools, or account enforcement where applicable.

Lumin Safety and Illegal Content Policy

Lumin is operated by Privado Designs, and this Policy explains how the platform addresses severe safety concerns, illegal content, real-world harm, exploitation, and other high-risk conduct. This Policy works together with the Terms of Use, Privacy Policy, Community Guidelines, and Moderation Policy on this page.
1. Zero-Tolerance Areas
Lumin does not permit content or conduct involving child sexual exploitation, grooming, sexual abuse, credible violent threats, terrorism, extremist violence, predatory behavior, coercive exploitation, or promotion of serious criminal conduct. Content or behavior in these areas may result in immediate removal and permanent account action without warning.
2. Illegal and Dangerous Conduct
Users may not use Lumin to facilitate crimes, traffic illegal goods or services, coordinate violence, threaten others, extort, defraud, exploit, distribute malicious links, or promote conduct that creates clear real-world harm. Lumin is not a shield for illegal behavior simply because the conduct occurs through a digital platform.
3. Threats and Credible Risk of Harm
If content, communication, or conduct suggests a credible risk of imminent or serious harm, Privado Designs may take immediate action, including account restriction, content removal, record preservation, and cooperation with appropriate legal or emergency channels where required or justified by law.
4. Child Safety
Lumin is intended for users age 18 and older. Any exploitative sexual content involving minors, any predatory interaction involving minors, or any content or behavior that endangers minors may be escalated immediately and may lead to permanent removal and legal reporting where required.
5. Self-Harm and Crisis Situations
Content that encourages self-harm, suicide, or related dangerous conduct may be removed or restricted. Privado Designs may take platform-level protective action when serious risk is reasonably believed to exist. Lumin is not a crisis service, not an emergency responder, and not a substitute for professional help.
6. Reporting Safety Concerns
Users should report content or accounts that appear to involve threats, exploitation, abuse, illegal conduct, or severe safety concerns. False or weaponized safety reporting may itself violate platform rules.
7. Messages and Safety Review
Private messages remain subject to Lumin’s rules. Where messages are reported or reasonably associated with severe safety, exploitation, or legal concerns, they may be reviewed to the extent reasonably necessary for support, moderation, safety action, legal compliance, or investigation.
8. Cooperation With Lawful Process
Privado Designs may preserve or disclose relevant records where required by law, lawful process, or serious safety circumstances, or where reasonably necessary to protect the Services, users, or the public from imminent or substantial harm.
9. No Emergency Services
Lumin and Privado Designs do not provide emergency services. If you are in immediate danger or experiencing a crisis, contact emergency services, law enforcement, or appropriate emergency professionals rather than relying on the platform.
